Earlier this year, the\u00a0US Copyright Office ruled against awarding copyrights<\/a>\u00a0to AI systems themselves. \u201cThe courts have been consistent in finding that non-human expression is ineligible for copyright protection,\u201d the Office reasoned in February, citing previous cases involving attempts to copyright based on \u201cdivine inspiration<\/a>,\u201d as well as that time someone tried to\u00a0secure copyright protection for a monkey selfie<\/a>.<\/p>\n\n\n\n

In the face of this, New York-based artist\u00a0Kris Kashtanova<\/a>\u00a0claims to be the first known artist to receive a US copyright registration for\u00a0Zayra of the Dawn<\/a><\/em>, a graphic novel featuring\u00a0latent diffusion<\/a>\u00a0AI-assisted artwork. <\/p>\n\n\n\n

\u201cI was open how it was made and put\u00a0Midjourney<\/a>\u00a0on the cover page. It wasn\u2019t altered in any other way. Just the way you saw it here,\u201d Kashtanova wrote in an announcement\u00a0posted to Instagram<\/a>\u00a0last week. \u201cI tried to make a case that we do own copyright when we make something using AI. I registered it as visual arts work. My certificate is in the mail and I got the number and a confirmation today that it was approved.\u201d Kashtanova also noted that they first got the idea to show that artists \u201cdo own copyright when we make something using AI\u201d from a \u201cfriend lawyer.\u201d<\/p>\n\n\n\n

The industry starts taking sides<\/h2>\n\n\n\n

On September 21, Getty Images CEO Craig Peters told\u00a0The Verge<\/a><\/em> that the company would no longer accept AI-generative artwork into its catalogue, citing concerns over copyright legality and privacy. \u201cThere are real concerns with respect to the copyright of outputs from these models and unaddressed rights issues with respect to the imagery, the image metadata and those individuals contained within the imagery\u201d <\/p>\n\n\n\n
